Supreme Court to Hear Challenge Against Chief Justice’s Removal Process

Accra, Ghana – April 9, 2025 – The Supreme Court is set to hear a case challenging the procedure for the potential removal of Chief Justice Gertrude Torkornoo.

The case was filed by Vincent Ekow Assafuah, MP for Old Tafo, who is questioning the constitutional steps taken by President John Dramani Mahama after receiving three separate petitions seeking the Chief Justice’s removal.

Legal Challenge

📌 Key Argument: Assafuah, represented by former Attorney-General Godfred Dame, argues that:
🔹 The Chief Justice must be given an opportunity to respond to the allegations before the President consults the Council of State, as required under Article 146(6) of the 1992 Constitution.
🔹 Skipping this step violates her right to a fair hearing and threatens the independence of the judiciary.

Chief Justice’s Response

On April 7, Chief Justice Torkornoo officially submitted her written response to the petitions, meeting the 10-day deadline set by President Mahama.
