Supreme Court to Hear NDC’s Challenge Against High Court’s Re-Collation Order

The Supreme Court is set to hear an application on Friday, December 27, 2024, filed by the National Democratic Congress (NDC) challenging the Accra High Court’s order for the Electoral Commission (EC) to collate and re-collate parliamentary election results in six constituencies.

The High Court, presided over by Justice Rev. Fr Joseph Adu Owusu Agyemang, had on December 20 directed the EC to finalize election results for Tema Central, Nsawam-Adoagyir, Ablekuma North, Ahafo Ano North, Techiman South, and Okaikwei Central, while also ordering the Inspector-General of Police to provide security at collation centres.

The decision followed mandamus applications filed by New Patriotic Party (NPP) parliamentary candidates, compelling the EC to conclude the collation process.

The NDC argues that the High Court breached natural justice by not granting its parliamentary candidates a hearing before issuing the order. In their Supreme Court filing, the NDC also claims the High Court failed to direct the applicants to notify other interested parties as required by law.

The EC had already re-collated results for seven out of nine constituencies on December 21, with NPP candidates emerging victorious in those constituencies. Re-collation for Dome-Kwabenya and Ablekuma North is yet to occur.

The Supreme Court’s decision will have significant implications for the affected constituencies and the broader electoral process.
